This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Standing Counsel for the State.

The grievance of the Petitioner in the writ petition is that appeal petition has been filed by the Petitioner challenging the order of the disciplinary authority is pending before the Appellate Authority and a direction may be given to the Opposite Parties, more particularly, the Inspector General of Police, Southern Range, Berhampur-Opposite Party No.1, to dispose of the Appeal petition dated 23.01.2018 of the Petitioner under Annexure-12. 4.

It is submitted by learned counsel for the Petitioner that the Appellate Authority is sitting over the matter and the same is still pending before the Inspector General of Police, Southern Range, Berhampur-Opposite Party No.1 and the said Opposite Party has not taken any decision on the appeal petition of the Petitioner as of now. 5.

Mr. K.K. Nayak, learned counsel for the State submits that he

// 2 // has no objection, if a direction is given to the Inspector General of Police, Southern Range, Berhampur-Opposite Party No.1 to consider the appeal petition of the Petitioner within a stipulated period of time. 6.

Considering the limited nature of grievance, this Court disposes of the writ petition with a direction to the Inspector General of Police, Southern Range, Berhampur-Opposite Party No.1 to consider the appeal petition of the Petitioner, if any, within a period of four weeks from the date of production of the certified copy of this order. It is needless to mention here that the appeal petition of the Petitioner shall be considered and disposed of by passing a speaking and a reasoned order on the same. The decision taken on the same shall be communicated to the Petitioner within a period of ten days thereafter.

With the aforesaid direction, the writ petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
