1. This matter is taken up through hybrid mode. Order No.

2. Heard Mr. A. Pattanaik, learned counsel for the petitioner and Mr. P.K. Maharaj, learned Additional Standing Counsel for the State.

3. The petitioner is in custody since 11.06.2020 in connection with G.R. Case No.623 of 2020 of the court of learned S.D.J.M., Khurda corresponding to Baghamari P.S. Case No. 55(12)/2020 for the alleged commission of offences under Sections 458/395/212 of the IPC read with Section 25 of the Arms Act and under Sections 4 and 5 of the Explosive Substance Act.

4. It is submitted that similarly situated co-accused persons, namely, Sukanta Behera, Akil Kumar Sahoo and Ratnakar Sahoo have been released on bail by order dated 01.09.2021 passed in BLAPL No. 6861 of 2021 order dated 15.10.2020 passed in BLAPL No. 5971 of 2020 and 16.10.2020 passed

in BLAPL No. 5972 of 2020 respectively.

Considering the submissions made and the fact that the co-accused persons have been released on bail, I find no reason to treat the petitioner differently than them. The bail application is therefore, allowed. Let the petitioner be released on bail on such terms and conditions as the court in seisin of the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting before the Court without any fail. Urgent certified copy of this order be granted on proper application.
