Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 27.01.2022 in connection with Khordha Model P.S. Case No.5 of 2022 corresponding to G.R. Case No. 16 of 2022 pending in the court of learned S.D.J.M., Khordha for the alleged commission of offence under Section 409 of IPC.

The petitioner was working as a Cashier in Mayur Transport Corporation. It is alleged that he misappropriated a sum of Rs.15 lakhs of the company's money in course of his official work. The petitioner's conduct came to light during audit. It is submitted by learned counsel for the petitioner that from the statement of the auditor, the total amount involved is Rs.15 lakhs, out of which more than Rs.3 lakhs has been secured by way of freezing his

bank account.

Considering the submissions as above, the materials on record, the period of detention in custody and the fact that charge sheet has already been submitted, I am inclined to allow the prayer for bail.

Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall furnish cash security of Rs.7 lakhs in the shape of short term fixed deposit in any Nationalized Bank being pledged to the court below. 7.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
