IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) No.3784 of 2022 Krushna Chandra Sahoo ....
Petitioner -versusTATA Power North Electrical Distribution Company Limited, Balasore (N.E.D.C.L.), Balasore and others.
....
Opposite Parties CORAM: JUSTICE S.PUJAHARI
ORDER
23.03.2022 02.
1.
This matter is taken up through hybrid mode.
Order No.
2.
Heard the learned counsel for the Petitioner. 3.
The grievance of the Petitioner is that the Opposite Parties have disconnected the power supply to his premises without considering his representation under Annexure-2. As such he has come to this Court seeking a direction to the Opposite Parties for reconnection of the power supply to his premises.
4.
As it is not disputed that due to non-payment of the electricity dues, disconnection of the power supply has been made to the premises of the Petitioner. A prayer has been made by the Petitioner that since he was on jail and he was not consuming the electricity, he is not liable to pay the electricity
// 2 // bill and, as such, the Opposite Parties be directed to give immediate reconnection without payment of electricity bill. The same is without any substance.
5.
Accordingly, the writ petition stands dismissed. 6.
However, if the Petitioner deposits 40% of the demanded amount within three weeks hence and undertakes to pay rest of the amount in 10 equal instalments along with regular bill, the Opposite Parties may do well to give reconnection to his premises, if there is no other legal impediment.
7.
Urgent certified copy of this order be granted on proper application.
