Kausalya Pradhan v. State Of Orissa
IN THE HIGH COURT OF ORISSA AT CUTTACK
W.A. No. 559 of 2016 Kausalya Pradhan ....
Appellant Mr. A. Kejriwal, Advocate -versusState of Odisha and Others ....
Respondents Mr. M.K. Khuntia, Addl. Govt. Advocate
CORAM:
THE CHIEF JUSTICE JUSTICE CHITTARANJAN DASH
ORDER
13.10.2022 Order No.
04.
1. The challenge in the present appeal is to an order dated 14th January, 2016 passed by the learned Single Judge dismissing the Appellant's writ petition i.e. W.P.(C) No.3321 of 2011. The Appellant was claiming promotion as a regular lady supervisor instead of contractual lady supervisor in terms of a notification dated 8th October, 2007 and seeking regularization from the date of initial appointment i.e. 7th January, 2010.
2. The learned Single Judge has rightly noticed the distinction between a contractual appointment and a regular appointment. The Appellant was unable to demonstrate even before the leaned Single Judge that she had any accrued right of promotion on a regular basis having been appointed on contractual basis. Even before this Court, the Appellant is unable to point out on what basis such a claim is being made.
3. Consequently, the Court is unable to find any error having been committed by the learned Single Judge. The appeal is accordingly dismissed.
