This matter is taken up by video conferencing mode. 2.

Learned Counsel for the Petitioner submits that whatever irregularities are said to have been committed by the Petitioner as have been found out in course of investigation, have been rectified by the Petitioner by depositing the said amount inadvertently disbursed during the period. In this connection, he has invited the attention of this Court to averments taken in paragraph-4 of the petition. He further submits that the co-accused has in the meantime been granted bail. It is also submitted that the Petitioner having remained under interim protection since 14.02.2020 has been abiding by the conditions imposed on him for the purpose. In view of all these above; he urges for grant of anticipatory bail to the Petitioner.

Learned Counsel for the State under instruction submits that the averments taken in paragraph-4 of the petition as above have been ascertained to be correct.

Considering the submissions and on going through the nature of accusations; further keeping in view the surrounding

// 2 // circumstances of the case as also concerning the Petitioner and in the absence of any other impediment, it is directed that in the event the Petitioner surrenders before the Court in seisin of the case in Salepur P.S. Case No.24 of 2020 corresponding to G.R. Case No.61 of 2020 pending on the file of learned J.M.F.C., Salipur within three weeks hence and moves for his release on bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the said Court.

The ABLAPL is accordingly disposed of.
