This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Kamakhya Nagar P.S. Case No.41 of 2022 corresponding to G.R. Case No.79 of 2022 pending in the Court of learned S.D.J.M., Kamakhyanagar for alleged commission of offences under sections 379/411/468/471/34 of the Indian Penal Code read with section 21 of the Mines and Minerals (Development & Regulation Act), 1957.

// 2 // Learned counsel for the petitioner on instruction submitted that some of the co-accused persons were arrested and they have already been released on bail. In view of the available material on record, while not inclining to grant anticipatory bail to the petitioner, I direct that in the event the petitioner surrenders and moves for bail before the learned Court below within a period of four weeks from today, the same shall be disposed of by the Court below as expeditiously as possible in accordance with law and claim of parity with the co-accused shall be taken into account at the time of adjudication of the bail application. The case diary be made available before the Court concerned for disposal of the case. The ABLAPL stands disposed of.

Urgent certified copy of this order be granted on proper application.
