Heard learned counsel for the petitioners and Mr.S.S.Pradhan, learned Addl. Government Advocate through hybrid mode.

In this application under Section 482 Cr.P.C. the order dated 28.03.2019 passed by the learned Asst. Sessions Judge, Nimapara in S.T. Case No.178/506 of 2013 under Annexure-2 has been challenged wherein N.B.W. of arrest has been issued against the petitioners as they were absent on repeated calls and no steps were taken on their behalf.

Learned counsel for the petitioners submits that due to communication gap between the petitioners and their counsel, the petitioners were unable to appear in the learned court below and no steps were taken on their behalf.

Although there is no illegality in the impugned order, in order to secure the presence of the petitioners during trial, it is

// 2 // directed that in the event each of the petitioners deposit an amount of Rs.500/- in the Welfare Fund of Orissa High Court Bar Association (total amount of Rs.2,500/-) and surrender before the learned court below within a period of four weeks and move for bail alongwith receipt of payment of cost of Rs.500/- each, they shall be released on bail on such terms and conditions as the learned court below may deem just and proper with the further condition that the petitioners shall appear before the learned trial court on each date when the case would be fixed for trial. Violation of any of the terms and conditions fixed shall entail cancellation of bail.

The CRLMC is accordingly stands disposed of.

Urgent certified copy of this order be granted on proper application.
