This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Appellants and learned counsel for the State. Perused the record and other relevant documents. 3.

The Appellants are accused in T.R. Case No.09 of 2022 arising out of Banpur P.S. Case No.224 of 2012 pending in the court of learned 1st Additional Sessions Judge, Khurda for commission of offence punishable under Section 294/447/323/354/506/34, I.P.C. and Section 3(i)(x) of the S.C. and S.T. (PA) Act. 4.

It is submitted by learned counsel for the Appellants that the Appellants were initially released on bail by this Court vide order dated 08.02.2013 in BLAPl No.3125 of 2013 and they were attending the court regularly but defaulted on 10.01.2020 for which N.B.W. of arrest was issued against them. Due to their serious illness, they could not attend the court on that date and the same was executed on 24.01.2022.

Having heard learned counsel for the parties and considering

// 2 // the age of the Appellants and period of detention, it is directed that let the Appellants be released on bail on furnishing a bail bond of Rs.20,000/- (rupees twenty thousand) each with one local solvent surety each for the like amount to the satisfaction of the learned court in seisin over the matter subject to conditions that the Appellants shall not default in attending the court during trial on each date fixed without fail, they shall not be involved in any offence of similar nature, he shall not tamper with the prosecution evidence or try to threaten or influence the witnesses in any manner whatsoever. Violation of any of the terms and conditions shall entail cancellation of bail.

It is open for the court in seisin over the matter to impose other conditions may deem just and proper.

The Bail Application is accordingly disposed of. 8.

Urgent certified copy of this order be granted on proper application.
