Heard learned counsel appearing for the petitioners. Order No.

2, Considering the submission of learned counsel appearing for the petitioners, this Court finds there is no finality to the I.A. 1 of 2021. It is on the other hand, the I.A. is posted to 17.2.2022. Keeping in view the request of opposite party to come up with objection and further there is also request of the Bar not to pass any adverse order without consent of the conducting counsel appearing for the respective parties. Be that as it may, considering the application involves urgency, this Court directs the matter may be taken up on 17.2.2022. In the event Bar is still pressing such resolution and learned counsel appearing for the opposite party is not appearing, the 2nd Additional Civil Judge (Sr.

Division), Cuttack is directed to postpone the matter at least for a period of ten days and direct the opposite parties to appear in person to conduct his case. If any notice is required to be issued to the opposite party involving I.A. No.1 of 2021 arising out of C.S.No.929 of 2021, notice may be issued to such party through special messenger but at the cost of the pettier and the I.A. shall be disposed of within seven days thereafter 3.
