This matter is taken up through Hybrid mode.

This petition has been filed by the Petitioner for transfer of C.S. No.1 of 2022 instituted at the instance of the Opposite Party-wife from the file of Judge, Family Court, Rayagada to the court of Judge, Family Court, Cuttack.

Heard learned counsel for the Petitioner.

There being no dispute with regard to the cause of action stated to be taken place at Rayagada within the territorial jurisdiction of the Judge, Family Court, Rayagada but the Petitoner-husband sought for transfer of the same from that court to the court of Judge, Family Court, Cuttack, this Court is not inclined to transfer the same from Rayagda to Cuttack on the ground of inconvenience and safety of the Petitiner-husband as no material is there to show that the Petitioner-husband has any danger to his life and limb from the side of the Opposite Party-

// 2 // wife and inconvenience of the wife is material for transfer not the vice-versa.

Accordingly, TRP(C) filed by the husband stands rejected.
