This matter is taken up through Hybrid arrangement (virtual/physical mode).

Heard learned counsel for the parties.

The Petitioner has filed this writ application seeking for a direction to Opposite Party No.3 to regularize the service of the Petitioner and to sanction periodical annual increments from the year 2012 till date with revision of pay under ORSP Rules, 2017 with effect from 01.01.2016 with all consequential service and financial benefits by treating the period of suspension from 08.05.2012 to 06.09.2012 as duty.

Learned counsel for the Petitioner submits that though the Petitioner has submitted a representation before the District Education Officer, Khordha, Opposite Party No.3 on 14.12.2021 but the same is still pending for consideration and a direction be issued to the Opposite Party No.3 to consider the representation of the

// 2 // Petitioner within a stipulated period of time. 5.

Learned Standing Counsel for School & Mass Education Department submits that he has no objection if a direction is issued to Opposite Party No.3 to consider the representation of the Petitioner in accordance with law.

In such view of the matter, this writ application is disposed of with a direction to Opposite Party No.3 to consider the representation of the Petitioner under Annexure-12, if such representation is still pending within a period of eight weeks from the date of production of certified copy of this order.

It is needless to mention here that the Opposite Party No.3 shall consider the representation of the Petitioner and dispose of the same by passing a speaking and reasoned order. Decision so taken on the representation of the Petitioner be communicated to the Petitioner within 10 days thereafter.

It is made clear that this Court has expressed no opinion on the merits of the case.

With the aforesaid observation the writ application stands disposed of.
