Heard Mr. R.C. Moharana, learned counsel for the Petitioners and Ms. S. Mishra, learned ASC for Opposite Party - State. 2.

It is submitted that Petitioner No.1, namely Abdul Kausher has been arrested in the meantime and as such the present application has become infructuous in his respect.

The CRLMC is confined to Petitioner No.2 - Sk. Alam only. 4.

Learned counsel for the Petitioner seeks permission for withdrawal of the application with liberty to surrender before the concerned Court.

Accordingly the CRLMC is disposed of granting liberty as prayed for. In the event Petitioner No.2 - Sk. Alam surrenders within a period of four weeks from today and prays for bail, his prayer for bail shall be considered in accordance with law including the grounds of parity, if any applicable, on the same day.
