CRLMC No.2173 of 2014 Amiya Swain @ Amiya Ranjan Swain ....

Petitioner versusState of Orissa and another ....

Opposite Parties CORAM: JUSTICE S. PUJAHARI Order No.

ORDER

28.03.2022 06.

1.

This matter is taken up through hybrid mode.

2.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the criminal proceeding initiated against the Petitioner in connection with Angul P.S. Case No.37 of 2014, corresponding to G.R. Case No.88 of 2014, pending in the Court of S.D.J.M., Angul.

3.

Heard.

4.

Since the F.I.R. allegation reveals prima facie a cognizable case, this Court is not inclined to quash the aforesaid F.I.R. 5.

But giving liberty to the Petitioner to file joint petition for quashment of the F.I.R., if so advised, as the Petitioner and victim are married in the meanwhile and living as husband and wife, this petition stands dismissed.
