IN THE HIGH COURT OF ORISSA AT CUTTACK

W.P.(C) No.3892 of 2022 Bibhuti Bhusan Malla ....

Petitioner Mr. P.K. Dash, Advocate -versusState of Odisha and others .... Opposite Parties Mr. B. Mohanty, ASC CORAM: JUSTICE S.K. PANIGRAHI

ORDER

15.02.2022 Order No.

01.

1. The matter is taken up through hybrid mode.

2. The petitioner has filed this writ petition seeking directions to the opposite parties, particularly to opposite party No.2 so as to rectify his father's name in the High School Certificate.

3. The learned counsel for the petitioner submits that the present petitioner namely Bibhuti Bhusan Malla of village-Parachhaka, P.S.-Sadar in the district of Kendrapara completed his secondary education in the year 1991 vide Roll No.490759 from Lalbahadur Ucha Sikshyasadan, Mehendipur under Board of Secondary Education, Orissa, Cuttack with 2nd division. The High School Certificate issued in his favour indicates his father's name as Sunakar Malla instead of Sanatan Malla. The present petitioner has approached the Board of Secondary Education, Orissa, Cuttack by way of a representation dated 03.02.2022, seeking the correction of his father's name on the strength of the Aadhar Card as well as some other documents.

4. The writ petition seems to be premature since the petitioner has approached the said authority on 03.02.2022. The petitioner was in

// 2 // a slumber sleep for the past 30 years. Suddenly, he has realised that there was a mistake in the father's name and has approached the authority without waiting for even a month from the date of representation. The petitioner has filed this present writ petition in harsh manner, which is nothing but the abuse of process of law.

5. This Court directs the petitioner to approach the appropriate authority and wait for the outcome for a reasonable time.

6. In view of such observation, the writ petition is disposed of.

7. Urgent certified copy of this order be granted as per rules. (S.K. Panigrahi) Judge pcd
