1. This matter is taken up through virtual mode.
2. It is submitted that notice has been served upon the victim. However, there is no appearance on behalf of the victim. Hence, the Bail Application is taken up for hearing.
3. Heard Mr. D.J.Sahoo, learned counsel for the Petitioners and Mr. P.K.Maharaj, learned Addl. Standing Counsel for the State.
4. The Petitioners are in custody in connection with Pattamundai P.S. Case No.700/2021 corresponding to G.R. Case No.141/2021 pending in the court of learned Sessions-
// 2 // cum-Special Judge, Kendrapara for the alleged commission of the offence under Sections 376(2)(n)(3) of I.P.C. and section 6 of POCSO Act.
5. Considering the severity of allegations and the existence of materials prima facie in support thereof, I am not inclined to allow the prayer for bail, which is therefore rejected. However, it is open to the Petitioner to renew his prayer after examination of the victim and the informant during trial. (Sashikanta Mishra) AKB Judge
