Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 27.12.2021 in connection with Niali P.S. Case No.361 of 2021 corresponding to G.R. Case No.339 of 2021 pending in the Court of learned J.M.F.C., Niali for the alleged commission of offence under Sections 498-A/304B/302/34 of IPC and Section 4 of DP Act. 4.
The petitioner is the elder brother-in-law of the deceased. It is alleged that he along with other family members demanded dowry and subjected the deceased to mental and physical cruelty on such account. The materials on record reveal that the deceased committed suicide by hanging herself from the ceiling fan of her own room by means of a saree.

The allegation against the petitioner appears to be omnibus in nature and even if the same are accepted on their face value, they do not conclusively show that the present petitioner was responsible for the commission of suicide by the deceased.

Having regard to the above facts and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 7.
BLAPL is accordingly disposed of.
