This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

This is an application U/S. 439 of Cr.P.C. by the petitioner for grant of bail in connection with Tentulikhunti P.S. Case No.103 of 2020 corresponding to C.T. Case No.46 of 2020 pending in the Court of learned Sessions Judge, Nabarangpur for commission of offences punishable under Sections 302/326 of IPC, on the allegation of committing murder of the deceased.

In the course of hearing of the bail application, Mr. R.L. Pattnaik, learned counsel for the petitioner submits that the star witness-Mr. Sripati Majhi has become hostile during the examination by the prosecution in the Court and all the allegations appearing against the petitioner are frivolous and has no basis and the petitioner having detained in custody for more than two years may kindly be

// 2 // enlarged on bail.

On the contrary, Mr. S.R. Roul, learned A.S.C. for the State by drawing attention of the Court to the statement of Mr. Sripati Majhi submits that the petitioner is the author of the crime and, therefore, the petitioner should not be enlarged on bail. 5.

After going through the allegations on record and the supporting evidence of witnesses recorded by the learned trial Court till today, this Court does not find any merit in the bail application of the petitioner.

Hence, the prayer for bail of the petitioner stands rejected. Trial be expedited as submitted by learned counsel for the petitioner. 7.

Accordingly, the BLAPL stands disposed of.
