This Civil Miscellaneous Petition is filed in the year 2020 challenging the order dated 30.10.2019 passed by the learned 3rd Addl. District Judge, Puri in confirmation of an order of the learned Civil Judge (Sr. Divn.), Puri involving an application U/o.39 Rule 1 & 2 of C.P.C.

Two years have already passed from the date of order and the Civil Miscellaneous Petition is not moved. Issuing notice after such lapse of time not only linger disposal of the suit, but will surely prejudice the parties otherwise.
