Heard Mr. R.L.Pattnaik, learned counsel for the Petitioner and Mr. P.Tripathy, learned Addl. Standing Counsel for the State.

The Petitioner is in custody since 23rd January, 2022 in connection with Orkel P.S. Case No.139/2021 corresponding to G.R. Case No. 70 of 2018 pending in the court of learned Sessions Judge-cum-Special Judge, Malkangiri for the alleged commission of offence under Sections 20(b)(ii)(C) & 27 A of the NDPS Act.

It is submitted that nothing was seized from the exclusive and conscious possession of the petitioner and he has

// 2 // been implicated in the case only because he happens to be the registered owner of the vehicle in which contraband article was transported.

Considering the submissions made, the materials on record, the period of detention already undergone and the fact that nothing was seized from the possession of the petitioner, I am inclined to allow the prayer for bail.

Let the Petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case, failing which necessary adverse orders may be passed against him.

The BLAPL is disposed of.

Urgent certified copy of this order be granted on proper application.
