This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State.

The limited grievance of the Petitioner in the present writ petition is that although her name was not recommended to Collector, Puri for promotion to the post of Odisha Revenue Service, Group-B service (ORS Group-B) as a result of which she has not been considered by the authority for the said post though she is eligible. 4.
It is submitted by learned counsel for the Petitioner that the authority has not recommended the name of the petitioner on the ground that her CCR for last five years are not available and that the petitioner was not having outstanding merit as on date for consideration and moreover, she was not found suitable for promotion to the post of ORS Group-B Service. He further submits that above the grounds was taken by the authority in not recommending the name of the petitioner for promotion but the
// 2 // names of the similarly situated persons have been recommended for promotion.

Learned counsel for the State submits that he has no objection, if a direction is given to the Opposite Parties to consider the representation of the Petitioner within a stipulated period of time. 6.
Having heard learned counsel for the parties, this Court finds that the grounds taken by the authorities are not elaborate and confusing and therefore, the matter recommend reconsideration by the authority for consideration of CCR of the petitioner for last five years in accordance with law. In such view of the matter, this Court disposes of the writ petition with a direction to the Petitioner to file a fresh representation highlighting all the grounds along with certified copy of this order before the Collector, Puri-Opposite Party No.4 within a period of ten days from today. In the event such a representation is filed within the aforesaid period, the Collector, PuriOpposite Party No.4 shall consider the same in accordance with law and rules and the same shall be disposed by passing a speaking and reasoned order within a period of three months from the date of filing of fresh representation. Any decision taken on the same shall be communicated to the Petitioner within a period of ten days thereafter. 7.
It is made clear that in the event the authorities come to a conclusion that the Petitioner is eligible, the case of the Petitioner shall be considered for promotion as expeditiously as possible and the Petitioner shall be given promotion from date similarly situated persons were given promotion.

With the aforesaid direction, the writ petition stands disposed
