Heard learned counsel for the petitioner and learned counsel for the State.

Present petition is filed by the petitioner under Section 482 Cr.P.C. for quashing of the criminal proceeding in G.R. Case No.559 of 2015 pending in the file of learned S.D.J.M., Sadar, Cuttack on the grounds stated therein.

Perused the FIR i.e. Annexure-1.

Learned counsel for the petitioner submits that there is no prima facie case considering the contents of the FIR. It is further submitted that the allegation is outrightly false as to the alleged mischief or overt act which is claimed to have been committed by the petitioner during incident.

Learned counsel for the State submits that he has no instruction whether the charge sheet is filed or not.

The Court is of the view that the matter is pending since 2015 without any real progress and it would be better, if liberty is granted to the petitioners to revive the matter, in the event of charge sheet being filed.
