Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 08.12.2021 in connection with Badambadi P.S. Case No.353 of 2021 corresponding to Spl. G.R. Case No.35 of 2021 pending in the Court of learned Sessions Judge-cum-Special Judge, Cuttack for the alleged commission of offence under Section 20(b)(II) of NDPS Act.

Considering the submissions made, materials on record and the fact that seized contraband is less than commercial quantity, being 8 Kgs of ganja, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that out of two sureties for such amount as may be determined by the Court below one should belong to the district of Cuttack and further he shall appear before the IIC of Badambadi Police Station once in every fortnight till submission of charge sheet.

BLAPL is accordingly disposed of.
