This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
Learned counsel for the State on instruction submitted that the notice contemplated under section 41A of Cr.P.C. has been served on petitioner and he has complied with the terms and conditions of the notice and therefore, there is no apprehension of arrest of the petitioner in connection with the case.
Learned counsel for the petitioner submitted
// 2 // that in spite of the service of notice under section 41A of Cr.P.C., the police is contemplating to arrest the petitioner.
In view of the statement made by the learned counsel for the State, since there is no apprehension of arrest, instruction shall be given accordingly by the learned counsel for the State not to arrest the petitioner in connection with this case except in accordance with sub-section (4) of section 41-A of Cr.P.C..
