This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Perused the report submitted by learned 2nd Addl. Sessions Judge, Cuttack. It appears that the accused has already been granted bail during pendency of the bail application of the petitioner before this Court. It was stated in the report that the accused-petitioner was granted bail on the petition of the learned State Defense Counsel who had appended a certificate to the effect that no bail application is pending before any other Court. This Court, however, taking into consideration the report submitted by learned 2nd Addl. Sessions Judge, Cuttack and submissions made on behalf of the petitioner to the effect that the bail application has become infructuous directs disposal of the bail application with a request to concerned learned State Defense Counsel to be extra vigilant while appending such certificate without verifying the case.

The BLAPL is disposed of as infructuous.
