1. At the outset, Mr. Patra, learned counsel for the Petitioner states that the issue in the present writ petition is confined to the demand as a result of short lifting MGQ of IMFL and Beer for the year 201415. He further states that the Petitioner has paid the entire license fee. Further issue of shifting of the shop does not arise since a new policy is in place.
2. Accordingly, since the issue involved in this case is covered by the decision of this Court dated 27th January, 2016 in W.P.(C) No. 6779 of 2015 (Shakti Prasad Mohanty vs. State of Orissa and Others) and since IMFL shop of the Petitioner remained closed from 1st August, 2014 to 14th November, 2014, the direction issued to the Petitioner to lift the shortfall MGQ is hereby quashed. In other words, the demand for the closure period is hereby quashed.
3. The writ petition is allowed in the above terms. No order as to costs.
