Heard learned counsel appearing for the petitioners. Order No.

Considering the issue involving grant of injunction upon disposal of an application under Order 39, Rule 3 of the Code of Civil Procedure has already come to held that for grant of status quo since is in the light of an order of injunction, no C.M.P. involving such order lies. It is on the other hand such order is appealable. In this circumstance, the C.M.P. is not entertainable at this stage. It is at this stage of the matter, learned counsel appearing for the petitioners does not want to press the C.M.P. and seeks a direction for early disposal of the I.A. involved herein..

Keeping this request in view, this Court observes in the event there is already appearance of the opposite parties involving the I.A. involving an application under Order 39, Rule 3 of the Code of Civil Procedure, the trial court shall do well in disposing such application at least within a period of fifteen days from the date of production of certified copy of this order by the petitioners but, however, providing opportunity to both the parties. 4.
