1. This matter is taken up through hybrid mode. Order No.
2. Heard Mr.Ashok Das, learned counsel for the Petitioner and Mr. S.K.Mishra , learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody since 19.05.2021 in connection with Digapahandi P.S. Case No. 26/2021,G.R.Case No. 190 of 2021 corresponding to S.T. Case No. 99 of 2021 pending in the court of learned 2nd Additional Sessions Judge, Berhampur, Ganjam for the alleged commission of the offence under Sections 147/ 148/ 294 /323 / 336/450/302/149 of the IPC.
4. Considering the submissions made, materials on record, the period of detention already undergone and the fact that several co-accused persons, namely, Santosh @ Kela Sethi, Upendra
// 2 // Nayak, Rajesh Gouda, Manoj Sethi and another and Sunil Kumar Nayak have been granted bail by this Court in BLAPL Nos. 9627, 10576, 10455, 9497 and 10561 of 2021 respectively, I am inclined to allow the prayer for bail.
5. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case failing which appropriate adverse orders may be passed as may be deemed fit and proper.
6. The BLAPL is disposed of.
7. Urgent certified copy of this order be granted on proper application.
