Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioners are in custody since 26.09.2021 in connection with Narla P.S. Case No.207 of 2021 corresponding to C.T. Case No.383 of 2021 pending in the Court of learned S.D.J.M., m. Rampur for the alleged commission of offence under Sections 498-A/304-B/34/306 of IPC read with Section 4 of D.P. Act.

The petitioner no.1 is the husband and petitioner no.2 is the mother-in-law of the deceased. It is alleged that the deceased was subjected to physical and mental cruelty by her in-laws including the petitioners in connection with their demand for dowry. In so far as the petitioner no.2 is concerned it is seen that the allegations are quite omnibus in nature, though the same cannot be said of petitioner no.1.

As such, considering the submissions, materials on record, period of detention in custody, I am inclined to allow the prayer for bail in respect of petitioner no.2. Let the petitioner no.2 (Gana Dei) be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that she shall personally appear before the trial Court on each date of posting of the case without fail.

The bail application in so far as petitioner no.1 (Simanchal Rana) stands rejected.
