Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 14.09.2021 in connection with Subalaya P.S. Case No.70 of 2020 corresponding to Spl. G.R. Case No.10 of 2020 pending in the Court of learned Addl. Sessions Judge-cum-Special Judge, Sonepur for the alleged commission of offence under Sections 20(b)(ii)C/29 of NDPS Act.

Though the prosecution allegation relates to recovery of huge quantity of contraband, yet in so far as the present petitioner is concerned, nothing was seized from his possession nor from the car in which he was traveling.

Having regard to the above facts, as also the fact that one of the co-accused persons, namely, Gopal Tandia, has already been released on bail as per the order passed by this Court in BLAPL No. 4576 of 2021, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and

conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
