1. Learned counsel for the Petitioner seeks leave to withdraw the writ petition with liberty to approach the Commissioner of Excise, Odisha, Cuttack.

2. The writ petition is disposed of as withdrawn with liberty as prayed for. If such application is filed not later than 1st February 2023 then it shall be decided after hearing the Petitioner within a period of three months thereafter.
