This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Dhenkanal Town P.S. Case No.361 of 2021 corresponding to C.T.
(Special) Case No.51 of 2021 pending in the court of learned Sessions Judge -cum- Special Judge, Dhenkanal for alleged commission of offences under sections 341/323/294/307/324/379/34 of the Indian Penal Code read with section 3(1)(r)(s), 3(2)(v)(va) of SC and ST (PoA) Act.
// 2 // In view of the available materials on record, the nature and gravity of the accusation, while not inclining to grant anticipatory bail to the petitioner, it is observed that in the event the petitioner surrenders in the Court below and moves for bail within a period of four weeks from today, the same shall be disposed of as expeditiously as possible by the Court below in accordance with law and if any coaccused has been released on bail in the meantime, the claim of parity shall be taken into account. The case diary be made available before the Court concerned for disposal of the case.
The ABLAPL is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
