This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Learned counsel for the State on instruction submitted that no first information report has been registered against the petitioner.

In view of such submission, since there is no F.I.R. in the case and there is no apprehension of arrest of the petitioner, I am not inclined to entertain the application under section 438 of Cr.P.C. The petitioner is at liberty to seek appropriate remedy after the registration of the F.I.R.

The ABLAPL is accordingly disposed of.

The interim order dated 08.03.2021 stands vacated.
