Heard learned counsel for the parties.

Learned counsel for the petitioner submits that the land in question has been forcibly acquired by the opp. parties, but in paragraph 5 of the counter affidavit filed by Opp. party No.4, it is stated that the opp. parties have not acquired the land of the petitioner.

Since there is a disputed question of facts, learned counsel for the petitioner submits that the petitioner may be permitted to withdraw the writ petition with liberty to pursue his remedy before the appropriate forum in accordance with law. 5.
