This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State. Perused the record.

The present writ petition has been filed by the petitioner with a direction to the opposite parties, more particularly to the Opposite Party No.3 to deposit the EPF dues for the month of February and March, 2008 till date of death of the deceased wife of the petitioner i.e. 27.03.2008 before the EPF Authority/Opposite Party No.4 for update of pensionary benefits of the petitioner.

It is submitted by learned counsel for the Petitioner that the only grievance of the petitioner is that the employer has not deposited the EPF dues for the month of February and March, 2008 as a result fixing a law of difficulties in not getting EPF pensionary benefits under the scheme.

It is further submitted by learned counsel for the petitioner that the petitioner highlighting his grievances filed a representation dated 28.10.2021 under Annexure-8 before the Managing Director, Orissa

// 2 // State Seed Corporation Ltd., Bhubaneswar-Opposite Party No.3, which is still pending before the said authority. He further submits that if a direction be given to the said Opposite Party for consideration of the representation of the petitioner in accordance with law within a stipulated time, the purpose would be solved. 5.

Learned counsel for the State submits that he has no objection, if a direction is given to the authorities to consider the grievance petition of the petitioner within a stipulated period of time. 6.

Considering the submissions made by the respective parties, the limited nature of grievance involved in the present writ petition, this Court disposes of the writ petition at the stage of admission with a direction to the Managing Director, Orissa State Seed Corporation Ltd., Bhubaneswar-Opposite Party No.3 to consider the representation of the Petitioner dated 28.10.2021 under Annexure-8 in accordance with law within a period of two months from the date of production of certified copy of this order. It is needless to mention here that the representation of the petitioner shall be considered and disposed of by passing a speaking and reasoned order on the same. Any decision taken on the same shall be communicated to the petitioner within a period of ten days thereafter.

In the event the petitioner is entitled to the claim as made in the writ petition, the Opposite Party No.3 shall take immediate action on the same within a month thereafter.

With the aforesaid observation, the writ petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
