Heard Mr. R.K.Mahanta, learned counsel for the petitioner and Mr. P.K.Mohanty, learned Addl. Standing Counsel through hybrid mode.

This is an application under Section 439 of Cr.P.C. for grant of bail to the petitioner-Birendra Khura in connection with Tentulikhunti P.S. Case No.165 of 2020 corresponding to T.R. Case No.346 of 2020 pending in the Court of learned Addl. Sessions Judge-cum-Special Court under POSCO Act, Nabarangpur for commission of offences punishable under Sections 376 (2) (n)/376 (3) of IPC read with Section 6 of the POCSO Act.

A memo for withdrawal of the bail application has been filed by the petitioner stating that the petitioner does not want to press this bail application and he may be permitted to withdraw the same. The memo be kept on record.

The BLAPL is dismissed as not pressed.

Urgent certified copy of this order be granted on proper application.
