1. This matter is taken up by hybrid mode.

3. In this writ petition the petitioner has assailed the arbitrary action of the opposite parties for non-payment of travelling allowances and luggage charges for journey to his native place in the State of Kerala after his retirement as envisaged under Rule-120 of the Odisha Travelling Allowances Rules. In this regard he had made representation before the opposite party No.2/Director of Higher Education Department, Odisha for redressal his grievance but the same was pending without consideration since 2020.
4. On the earlier occasion the notice was issued to the opposite parties, in response to which, learned counsel for the State placed the instruction vide letter No.2P-07-6-NCC-17757/HE dated 02.05.2022 issued by the Deputy Director, of
// 2 // Department of Higher Education, Government of Odisha to the Group Commander, NCC Group Hqrs. Berhampur. The relevant portion of which is extracted hereunder: xxx xxx xxx " In inviting a reference to Your Letter No.1606 dtd. 06.06.20212 and Letter No. 4002 Dtd.
06.12.2012 on the subject cited above, I am directed to say that as per your proposal cited above an amount of Rs.16,682/- ( Rupees Sixteen thousand six hundred eighty two) only has been released for payment of T.E. in favour of Sri C.V. Phillip, Retd. Jr. Clerk of your unit.
Therefore, you are requested to take urgent necessary steps to make payment of the same to Sri Phillips and submit the acquaintance role to this Department at the earliest in order to make necessary compliance before the Hon'ble High Court in W.P(C) No.94125 of 2022.
5. In view of the aforesaid instructions, it is ascertained that the grievance of the petitioner has already been redressed. Accordingly, the Writ Petition is disposed of.
