Heard Mr. B.K. Nayak, learned counsel on behalf of Mr. P.K. Das, learned counsel for the petitioner and Mr. S.S. Pradhan, learned Addl. Govt. Advocate.

2. This application under Section 407 of Cr.P.C. has been filed by the petitioners praying for transfer of two cases are pending in the Court of the learned J.M.F.C., Khariar vide G.R. Case No. 100 of 2012 and 104 of 2012 to the Court of the learned Sessions Judge, Nuapada by transferring/tagging to G.R. Case No. 101 of 2012 (S.T. Case No. 835 of 2013) which is pending before the learned Sessions -cumDistrict Judge, Nuapada. 3.

Mr. B.K. Nayak, learned counsel on behalf of Mr. P.K. Das, learned counsel for the petitioners submits that the petitioners do not want to proceed with this TRPCRL and may be permitted to withdraw the same and files a memo to that effect. The same be kept on record. 4.

Considering the above submission, the TRPCRL is dismissed as withdrawn.

Issue urgent certified copy as per rules.
