This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

None appears for the petitioner at the time of call, so also no one had appeared for the petitioner when the matter was last listed on 02.05.2017. A bare perusal of record would indicate that the defect as pointed out has not yet been removed. Further, the petitioner by way of an application U/S. 482 of Cr.P.C. seeks to quash the NBWA issued against him on 17.11.2014 by learned Sessions Judge, Khurda, Bhubaneswar in T.R. Case No. 51 of 2013 but execution of such N.B.W.A has not been stayed by this Court and in the meantime, around eight years have passed from the date of passing of impugned order. In view of the above facts, this Court reasonably entertains a doubt as to whether the cause of action still survives for the petitioner in this case.

In view of such, the CRLMC is dismissed.
