1. Mr. Chinmaya Panda, learned counsel appear on behalf of the Order No.

Petitioner.

2. On the last date, the learned counsel for the Petitioner sought to take instruction in the matter. In the present application, the Petitioner seeks to quash the order of cognizance dated 21st November 2013 passed by the learned Judicial Magistrate, First Class, Saintala, Bolangir in G.R. Case No.70 of 2013.

3. The learned counsel for the State on the contrary submitted that the charge sheet has already been filed in the case.

4. Keeping in view the age of the case, in absence of an interim stay, the matter could not have been kept alive at the stage the application was presented before this Court. Hence, there is no point in waiting for instruction in the matter which did not come despite the time being allowed. The CRLMC is accordingly, dismissed. (Chittaranjan Dash) Judge B.C.Mohanty
