The petitioner has filed this writ petition seeking direction to the opposite parties to pay the petitioner escalation bill amount vide Annexure-3 series due to price variation in the rate of material, POL and Labour under the Contract Agreement as per Escalation Clause in DTCN. Since the petitioner claims for escalation bill amount, it is open to him to pursue the remedy before the appropriate forum in terms of the DTCN/agreement executed between the parties, which is applicable to them. 3.

With the aforesaid liberty, the writ petition stands disposed of.
