This matter is taken up through Hybrid mode.

Petitioner in this writ petition prays for a direction for early disposal of CP No.217 of 2018 stated to be pending before learned Judge, Family Court, Khordha.

It is submitted by learned counsel for the Petitioner that hearing of the said CP has already commenced and due to intervention of resurgence of pandemic of COVID-19, hearing could not proceed substantially. However, the Courts have started functioning normally and there is no legal impediment for disposal of the aforesaid Civil Proceeding. Hence, this writ petition is filed for the aforesaid relief.

Taking into consideration the submission of Ms. Pattnaik, learned counsel for the Petitioner and on perusal of the order sheet of the Civil Proceeding annexed to the writ petition, it appears that due to resurgence of COVID-19, the parties were not attending the proceeding of CP No.217 of 2018 since 18th September, 2021.

However, taking into consideration the submission of Ms. Pattnaik, learned counsel for the Petitioner, the writ petition is disposed of with a direction that in the event the Petitioner makes an application for early disposal of CP No.217 of 2018 stated to be pending before learned Judge, Family Court, Khordha within a period of two weeks hence stating the grounds therein, learned Judge, Family Court, Khordha shall do well to consider the same in accordance with law as expeditiously as possible, preferably within a period of four weeks there from and proceed with the matter accordingly. Issue urgent certified copy of the order on proper application.
