Heard learned Counsel for the Petitioner, so also learned Counsel for the Bank.

A prayer has been made in the present Writ Petition to quash the letter dated 28.07.2016, as at Annexure-6, and letter dated 13.10.2016, as at Annexure-9, vide which the Petitioner was intimated that her application for Family Pension sent to the State Bank of India, CPPC, Bhubaneswar, with its related file and documents were returned along with a calculation sheet for recovery of Rs.3,92,069/- which was credited towards the pension in the pension account of her late husband Dasarathi Behera, bearing savings Bank Account No.1099415771.

It has also been indicated vide the said communication that she being the joint account holder of the said Pension Account of her late husband, has withdrawn the said amount from the concerned Account after the death of her husband and she need to deposit the

said amount as per the calculation sheet in the bank as early as possible for further transmission of her application for Family Pension to the State Bank of India, CPPC, Bhubaneswar for necessary action at there end.

During hearing of the matter, learned Counsel for the Petitioner submits that the Petitioner is ready and willing to deposit the said calculated amount of Rs.3,92,069/- in terms of the communication dated 13.10.2016, as at Annexure-9, within two weeks hence.

Needless to mention here that on depositing the said calculated amount, as indicated vide communication dated 13.10.2016, as at Annexure-9, her application for Family Pension dated 15.09.2016, as at Annexure-8, be processed by the Authority concerned within four weeks from the date of deposit of the said amount enabling her to get the Family Pension including arrears, if any, in terms of the Rules and Regulations of the Bank governing the provisions of Family Pension.
