2. Heard Mr.B.B.Mohanty, learned counsel for the petitioner, Mr. A.K.Mishra, learned Addl. Government Advocate for opposite party Nos.1 to 4 and Dr. J.K.Lenka, learned counsel for opp. party No.5.

The petitioner files this writ petition assailing the orders dated 16.05.2017 and 29.06.2016 passed in O.A.No.2036 (C) of 2015, as well as the order dated 11.06.2015 passed in O.A. No.2036 (C) of 2015.

Mr. B.B.Mohanty, learned counsel for the petitioner contended that against the ex parte order dated 29.06.2016 passed by the Odisha Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No.2036 (C) of 2015, the petitioner approached this Court. It is further contended that even though the petitioner filed Misc. Petition No.873 (C) of 2016 for recalling of the said order, the same was dismissed by the tribunal, vide order dated 16.05.2017. It is further contended that the petitioner had also approached the tribunal by filing O.A.(C) No.4554 of 2016, which has been transferred to this

Court and re-numbered as WPC (OAC) No. 4554 of 2016 and, as such, the same is pending before this Court for adjudication. Therefore, the petitioner may be permitted to pursue the said writ petition raising all the points, which are taken in the present writ petition, to which learned counsel for the opp. parties has raised no objection.

In view of the above submission, the writ petition stands disposed of permitting the petitioner to pursue his remedy in WPC (OAC) No.4554 of 2016, raising all the points taken in the present writ petition.
