Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 27.07.2021 in connection with Nayagarh Sadar P.S. Case No.115 of 2021 corresponding to S.T. Case No.194 of 2021, pending in the Court of learned Sessions Judge, Nayagarh for the alleged commission of offence under Sections 498-A/304-B/302 of IPC read with Section 4 of DP Act.

The petitioner is the husband of the deceased. The materials on record reveal that the petitioner and his family members subjected the deceased to mental and physical torture in connection with their demand for further dowry, due to which she is said to have committed suicide. It is however, alleged that the deceased was killed and her death was projected as a suicide, which would be evident from the fact that she was found hanging but with her legs on the bed.

Having regard to the fact that there are strong prima facie materials to show the involvement of the petitioner in the occurrence, I am not inclined to allow the prayer for bail. It is however open to the petitioner to renew his prayer after examination of the informant and some material witnesses. 6.

BLAPL is accordingly rejected.
