1. The matter is taken up through hybrid mode.

2. Heard learned counsel for the petitioner and learned counsel for the State.

3. The petitioner is in judicial custody in connection with Kumbharapada P.S. Case No.47 of 2020 corresponding to T.R. Case No.05/105 of 2020 of the court of learned Special Judge, Puri for commission of offence under Section 20(b)(ii)(C) of the NDPS Act read with Section 120-B/34 of the IPC. He has filed this petition for bail.

4. The prosecution case in brief is that on getting information, the informant and his staff proceeded to Municipality Bus Stand, Puri suspecting transportation and selling of Ganja and found two men and one lady standing there holding two bags. The police

// 2 // apprehended them and found two bags weighing 35.150 kgs of Ganja in their presence.

5. Learned counsel for the petitioner submits that the petitioner is in custody since 08.02.2020 and charge-sheet has been filed. The petitioner has no criminal antecedent and he is a young boy of 24 years. So, the bail petition may be allowed.

6. Learned counsel for the State opposes the bail prayer of the petitioner on the ground that out of 40 charge-sheeted witnesses, 8 have been examination and trial is in progress.

7. Considering the aforesaid facts and submissions, the BLAPL is rejected.

8. The trial court is directed to conclude the trial within a period of six months from today.
