This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

This is an application for extension of the date of surrender of the petitioner in the learned Court below. Learned counsel for the petitioner submits that the petitioner could not surrender before the learned trial Court as per the order dated 23.02.2022 since he was ill. It is further submitted that some of the co-accused persons have already been released on bail and therefore, the learned trial Court may be directed to consider the claim of parity with the release of the co-accused persons on bail at the time of adjudicating the bail application of the petitioner.

Considering the submission made by the learned counsel for the petitioner, the date of surrender of the petitioner as fixed as per order dated 23.02.2022 is extended till 16th May

The learned trial Court is directed to consider the claim of parity with the release of the co-accused persons on bail at the time of adjudicating the bail application of the petitioner. The rest part of the order dated 23.02.2022 remains unaltered. It is made clear that no further extension of date of surrender shall be granted.

I.A. is accordingly disposed of.
