CORAM:

THE CHIEF JUSTICE JUSTICE CHITTARANJAN DASH Order No.

ORDER

26.09.2022 07.

1. The impugned order dated 12th January, 2018 of the learned Single Judge has dismissed the W.P.(C) No.11054 of 2016 of the present Appellant at a stage when the Orissa Administrative Tribunal (OAT) was still functioning. The writ petition was dismissed on the ground maintainability implying that the Appellant should approach the OAT.

2. Now, that the OAT stands abolished, that remedy is no longer available to the Appellant. The impugned order dated 12th January, 2018 is accordingly set aside and W.P.(C) No.11054 of 2016 is restored to the file of the Roster Bench of the Single Judge where it will be listed on 21st November, 2022. Reply to the petition shall be filed by the State on or before 14th November, 2022 and rejoinder thereto, if any, be filed before the next date by the Petitioner, i.e., the Appellant herein. No further time will be granted for that

purpose. The learned Single Judge is requested to proceed to hear the writ petition on merits and dispose it of as expeditiously as possible.

3. The writ appeal is disposed of in the above terms.
