ORDER
23.3.2022.
Order No.
02.
1. This matter is taken up through virtual mode.
2. Heard Mr. K.K.Pahil, learned counsel for the Petitioners and Mr. P. Tripathy, learned Addl. Standing Counsel for the State.
3. The Petitioners are in custody since 8th April, 2021 in connection with Cuttack Sadar P.S. Case No.555/2020 corresponding to G.R. Case No.2362-A/2020 pending in the court of learned J.M.F.C. (Rural), Cuttack for the alleged commission of the offence under Section 302 of the I.P.C.

4. The prosecution allegation is that the Petitioner assisted the husband of the deceased in killing her. Though the Petitioner has not been named in the F.I.R, yet from the statement of some witnesses recorded under Section 161 of Cr.P.C., it is evident that he had played an active role in not only killing the deceased but also in attempting to sell her ornaments after her death.
5. Considering the nature of accusations and the existence of materials prima facie in support thereof, I am not inclined to allow the prayer for bail, which is therefore rejected. (Sashikanta Mishra) AKB Judge
