This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel appearing for the Opposite Parties. Perused the writ petition and the documents as annexed thereto.

The present writ petition has been filed by the Petitioner seeking for a direction to Opposite Party No.2 to consider the case of the Petitioner for admission into U.G. Course i.e. in B.Sc.(Hons.) Agriculture in the college of Agriculture as Reserved Category (S.C.).

Learned counsel for the Petitioner submits that the Petitioner belongs to Scheduled Caste category and had applied under the said category for admission into Opposite Party No.1-Orissa University of Agriculture and Technology (OUAT) and accordingly appeared in

// 2 // the Common Entrance Test of OUAT. The Petitioner had secured 88 marks out of total 200 marks. It is further submitted that the Petitioner was noticed to appear in the counseling conducted by the Opposite Party No.1-University. It is further submitted that the Opposite Party No.1 had conducted one round of counseling for admission into B.Sc (Hons.), Agriculture Course. Thereafter, the remaining unfilled seats were put for short counseling. 5.

Learned counsel for Petitioner further submits that the Petitioner did not get adequate opportunity to get admission under the S.C. category seats. In total 211 seats in B.Sc. (Hons.), Agriculture Course in the college of Agriculture, Bhubaneswar under Opposite Party No.1. Out of which 122 seats were considered as General seats since the Petitioner did not get a chance to take admission in the college of Agriculture under Opposite Party No.1, the present writ petition has been filed seeking intervention of this Court. 6.

Mr. A. Pal, learned counsel appearing for the Opposite Parties submits that in the meantime seats have been filled up by the college of Agriculture, Bhubaneswar, however, on quarry being made by this Court, Mr. Pal, on instruction appraised this Court that in the event the Petitioner makes a representation to the college authorities, then the college authorities shall consider the request of the Petitioner for getting admission into B.Sc.(Hons.) Agriculture in cost sharing seat, to which the learned counsel for the Petitioner agrees. 7.

Considering the aforesaid submissions made, this Court, disposes of the writ petition at this stage of admission with a direction to the Petitioner to file a representation before the college authorities within a period of one week along with certified copy of this order. In the event, such a representation is filed, the same shall be considered by the College of Agriculture, Bhubaneswar and the

// 3 // Petitioner may be accommodated in one of the cost sharing seats subject to availability and subject to petitioner's fulfilling other criteria for admission. The entire exercise shall be completed within a period of four weeks from the date of production of certified copy of this order.

With the aforesaid observation, the writ petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
